Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the oneCDP Customer Data Platform (the "Service") provided by Ioffe & Friends Associação Cultural (the "Company", "we", "us"). By using the Service you agree to these Terms.

1. The Service

oneCDP is a Customer Data Platform (CDP) that collects, unifies and activates customer data. The scope and features available depend on the plan you select.

2. Accounts and access

You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. You are responsible for all activity under your account and must notify us promptly of any unauthorised use.

3. Trial and subscriptions

We may offer a time-limited evaluation of the Service with optional functional limitations. Paid plans and their features are described on our website. You may upgrade to a paid plan at any time.

4. Fees and payment

Fees are set out on our pricing page and are stated in euro (EUR) unless indicated otherwise, exclusive of applicable taxes. We may update fees by publishing the new pricing; changes apply from the next billing period.

5. Acceptable use

• do not use the Service unlawfully or in breach of third-party rights;
• do not upload content that is illegal or infringing;
• you are responsible for processing personal data through the Service in compliance with the GDPR and applicable law (as controller of your end-customer data).

6. Intellectual property

The Service, including its software and content, is owned by the Company or its licensors. These Terms do not grant you any rights other than the limited right to use the Service.

7. Confidentiality

Each party shall protect the other's confidential information disclosed in connection with the Service and use it only as necessary to perform under these Terms.

8. Warranties and liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Company is not liable for indirect or consequential losses or lost profits. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Force majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control.

10. Governing law and disputes

These Terms are governed by the laws of the European Union member state in which the Company is established. The parties will first seek to resolve disputes amicably; failing that, disputes are subject to the competent courts of the Company's place of establishment.

11. Changes to these Terms

We may update these Terms; the current version is always available at https://onecdp.eu/terms. Continued use of the Service after changes constitutes acceptance.
